Terms and Conditions for Use Membership and Sales

1. General

Your use of this website and any service contained within constitutes acceptance of these Terms & Conditions. Please take the time to read through these before continuing to use the Website. On accessing the Website on this and on each subsequent occasion you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities and services provided by it. We reserve the right to alter these terms and conditions at any time and it is your obligation to check if changes have been made. Your use of the Website after changes are posted on-line shall constitute acceptance of the new terms and conditions.

In these terms and conditions:

"Website" means the website Tenantstips.com;

"you"/"your" means the user of the Website.

“object(s)” means items of any nature returned from searches or other external parties displayed on the site.

The information in these pages may be updated from time to time and may at times be out of date. Neither tenantstips.com nor any other party involved in creating, producing or delivering the Site, is liable for any direct, incidental, special, consequential, indirect or punitive damages arising out of the User’s access to, or use of, or inability to use the Site or any linked site or for the cost of procurement of substitute goods or services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the Site or resulting from any unauthorised access to or alteration of your transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible property including legal costs and expenses, even if tenantstips.com has been advised of the possibility of such damages.

The User expressly agrees that the downloading of any material form the Site is at the User’s own risk. Neither tenantstips.com nor any other party involved in creating, producing or delivering the Site, is liable for any direct, incidental, special, consequential, indirect or punitive damages resulting from the User downloading material from the Site or any linked site, including but not limited to, damages for loss of profits, use, data or other intangible property including legal costs and expenses, even if tenantstips.com has been advised of the possibility of such damages.

The Website contains material submitted and created by individuals, external suppliers and other third parties. We exclude all liability for any illegality arising from or error, omission or inaccuracy in such material.

We give no warranties, conditions, guarantees or representations, express or implied, as to:-

1. the completeness or accuracy of the advice and information contained on the Website or any website to which it is linked;

2. the content of the advertisements for objects included in our database, including but not limited to the ownership, quality, authenticity of any photographs, compliance with description or fitness for purpose of any such objects;

3. the completeness of the results of any search of our database or that the objects selected by the search are the only objects on our database which might meet the searcher's requirements.

We reserve the right to assign or subcontract any or all of our rights and obligations under these terms and conditions to a third party. If we exercise this right, we shall name the assignee or subcontractor on the Website and you will be entitled to terminate the account within 6 working days. You may not without our prior written consent assign or dispose of any rights or obligations arising under these terms and conditions.

To gain access to certain services on the Website you will need to register. As part of the registration process, you will be given a username and password. You agree that the information supplied with your registration will be truthful, accurate and complete. You also agree that you will not attempt to register in the name of any other individual nor will you adopt any username with we deem to be offensive. All personal information supplied by you as part of the registration process will be protected and used in accordance with the terms of our Privacy Policy.

2. Customer Information

2.1 You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment.

2.2 You are responsible for maintaining your own username and password, where required to access your customer account. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.

2.3 As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

2.4 Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the supplier for use or consumption by children.

2.5 The use of the Site signifies the User’s consent to tenantstips.com collecting and using personal information about the User in accordance with tenantstips.com’s Privacy Policy.

2.6 The User does not have to register to use the Site in order to access it and enjoy the content other than the Paid-for Content. If the User wishes to access the Paid-for Content the User will be asked to provide tenantstips.com with accurate, complete registration information, including contact details, and it is the User’s responsibility to update and maintain this information. Tenantstips.com is entitled to rely on this information to provide Paid-for Content.

2.7 The User will also be requested to create a Password in a format specified by tenantstips.com (“the Password”). The User shall not disclose the Password to any other person or entity and shall ensure that the Password remains confidential at all times. In the event that the User knows or has a reasonable suspicion that a third party knows the User’s Password, the User shall notify tenantstips.com immediately by contacting tenantstips.com at members@tenantstips.com. If tenantstips.com has reasonable grounds for believing that the User has misused or is misusing the Password, tenantstips.com may require the User to change the Password or may suspend the User’s use of the access to the Site, including Paid-for Content, until such time as tenantstips.com is satisfied that the security of the Site is no longer compromised by the User’s activities.

4. Products and Services, Fees and Pricing and Title

Tenantstips.com shall provide Free and Paid-for Content. This includes a subscription for Paid-for Content available. Tenantstips.com reserves the right to vary the Free and Paid-for Content and does not guarantee that the content provided free of charge (“Free Content”) will remain free of charge and does not guarantee that the content provided subject to payment (“Paid-for Content”) will remain a paid-for service. We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the electronic shipment of that order and any related items.

4.1 The User shall agree to pay any subscription fees (“Fees”) at rates in effect when the charges are incurred. The User must provide tenantstips.com with complete and accurate payment information. The User can pay using a credit or debit card or by setting up a standing order. By submitting credit or debit card details to tenantstips.com the User warrants that they are entitled to purchase the Paid-for Content using those payment details. In the event of an unauthorised payment tenantstips.com reserves the right to suspend or terminate the User’s access to the Site and Paid-for Content. If no payment authorisation is received or payment authorisation is subsequently cancelled, tenantstips.com may immediately terminate or suspend access to any Paid-for Content and/or the Site. Tenantstips.com will try to process the User’s request for any Paid-for Content promptly but does not guarantee that the Paid-for Content will be available to the User by any specified time. A contract with the User for a Paid-for Content will come into effect when the Username and Password are issued to the User.

4.2 We reserve the right to alter all product pricing without notice.

4.3 Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped.

5. Your Order

5.1 When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order.

5.2 Your offer is only accepted by us once we have emailed you to confirm the electronic dispatch of your order.

5.3 Product items not included within the dispatch email are not included in the order and contract between you and us.

5.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.

5.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.

6. Cancellation Rights and Refunds

6.1 The User having paid the Fee for a subscription for the supply of Paid-for Content for a defined period will have no right of cancellation for the supply of the Paid-for Content other than the right to cancel the subscription for Paid-for Content. This does not affect the User’s statutory rights. No right of cancellation exists under The Consumer Protection (Distance Selling) Regulations 2000 for downloaded goods, online access, electronic or “softcopy” goods to which you, the customer has instant access to or use of.

6.2 Refunds will be given for any goods where they are found by us to be defective.

6.3 Refunds will not be given where we are unable to replicate the issue or the issue stems from the user or their equipment.

6.4 Where any goods are found to be defective we will offer a replacement item or issue a full refund at our discretion. Where a refund is offered and accepted by you it will be made within seven working days of receiving your acceptance of a refund.

7. Customer Complaintsand Dispute Resolution

We endeavour to respond to all customer complaints or queries within five working days. Contact us.

8. Events outside our control

Tenantstips.com , shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.

9. Licence

9.1Tenantstips.com , grants you a licence to access the content, information and services contained within our website for personal use only.

9.2 This licence allows you to download and cache (using your browser) individual pages from our website.

9.3 This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.

9.4 Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.

9.5 Our website cannot be placed within the frame-set of another site.

9.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.

9.7 The restriction on “deep linking” does not apply to affiliate partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales.

10.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are the copyright of Tenantstips.com , unless expressly acknowledged as otherwise.

10.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.

11. Reasonably Foreseeable Losses

11.1Tenantstips.com will be liable for any losses incurred by you due to breaches of these Terms & Conditions by us, where such losses were reasonably foreseeable at the time the contract between you and us was made.

11.2 All business, indirect or consequential losses not reasonably foreseeable at the time of the contract between you and us are excluded.

11.3Tenantstips.com does not exclude or limit liability for death or personal injury caused by the negligence or breach of duty by us, our employees or officers.

12. Severability

The foregoing paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

13. Waiver

Failure by Tenantstips.com to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing.

14. Indemnity

The User agrees to indemnify, keep indemnified, defend and hold tenantstips.com and its parent companies, subsidiaries, affiliates and their respective officers, directors, employees, owners, agents, information providers and licensors, (collectively the “Indemnified Parties”) harmless from and against any and all claims, damages, liability, losses, costs and expenses (including legal fees) (whether or not foreseeable or avoidable) incurred or suffered by any Indemnified Party and any claims or legal proceedings which are brought or threatened arising from the User’s use of, connection with or conduct on the Site or any breach by the User of these terms. Tenantstips.com reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by the User, and in such case, the User agrees to co-operate with the defence of such claim.

14. Entire Terms & Conditions

These Terms & Conditions set out the entire agreement and understanding between you and Tenantstips.com . We reserve the right to change these Terms & Conditions at any time, without giving notice to you.

15. Jurisdiction

These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts. If any of these terms and conditions shall be held to be invalid or unenforceable, it shall not affect the enforceability of any of the remaining provisions. If you do not agree to obey these terms and conditions you must stop using the Website immediately. Your statutory rights are unaffected.
